Terms of Service

This Photography Services Agreement is entered into and made effective as of October 18th, 2022 by and between the following parties: Elijah M Negaard and the Customer. The Photographer shall not be liable for any compromised Photography Services due to causes beyond the Photographer's control, such as weather, decorations, lighting, or any other causes or factors. The photographer holds all copyright in and to any images produced. Photographer will not transfer copyright to the images, but will allow Customer personal and commercial use of the images as follows: Personal photographs may be used in any manner, as long as credit is applied to the photographer. For any commercial use, the Customer shall ensure all images are displayed with the following caption: Photography by Elijah M Negaard. Any use beyond that which is described above shall be unlawful. Should the Photographer be subject to any hostile words, threats, or other inappropriate, threatening, or violent behavior, Photographer reserves the right to immediately terminate this Agreement. Any funds already paid to Photographer in such termination will be forfeited by the Client. Should Client cancel this Agreement prior to Photographer's completion of any work, Client will not be due any refund of funds already paid. Future payments will be canceled. The Photographer represents and warrants that it will perform the Photography Services using reasonable care and skill for a Photographer in their field and that any results, end products, or materials given by the Photographer to the Client under the terms and conditions of this Agreement will not infringe on or violate the intellectual property rights or any other right of any third party.
